The Legal Services Division provides legal advice and assistance to the Minister for Government Services, the Secretary and the department’s executive, and delivers legal services within and on behalf of the department. The division also manages privacy complaints, freedom of information and release of information requests and customer compensation matters.

The Legal Services Division is establishing a merit pool to fill Senior Government Lawyer positions as they arise across the Division.

Senior Government Lawyers are responsible for providing high-quality legal services to the Deputy General Counsel and General Counsel, including assisting with the governance and strategic direction for the relevant Branch. You will be required to work collaboratively, manage, guide and second counsel advice prepared by junior lawyers, manage stakeholders (internal and external) and assist with internal reporting/briefing requirements.

The Legal Services Division includes:

Commercial Law and Customer Compensation Branch provides legal advice on a range of commercial matters (ICT, real property and general commercial) including procurement, contract drafting and negotiations, contract management and dispute resolution, branding and media, and other commercial arrangements between the department and private businesses. It advises holistically on legal and commercial strategy for significant departmental projects. It also processes claims for compensation relating to the Centrelink, Child Support and Medicare programmes, including legal liability claims and claims under the scheme for Compensation for Detriment caused by Defective Administration.

Business Transformation Legal Branch provides legal advice on the Welfare Payment Infrastructure Transformation Programme, eGovernment, digital projects and managed telecommunications services, and provides legal operations support to the Legal Services Division.

Programme Advice and Privacy Branch provides advice in relation to all departmental programmes and legislation, including Medicare and health programmes, Child Support and Centrelink programmes, including in respect of investigations into fraud and non-compliance, manages departmental delegations and authorisations and statutory appointments, advises on privacy and secrecy law and manages operational privacy matters.

Litigation and Information Release Branch manages matters before tribunals and courts, including debt litigation for Centrelink and Child Support programmes, manages the release of personal information via administrative processes and is the first point of contact for subpoenas, summons and notices of non-party disclosure.

Employment Law and FOI Branch provides legal advice on employment law and industrial relations matters, as well as incidents of customer aggression, manages employment and industrial relations litigation, requests for legal assistance to Commonwealth employees in accordance with the Legal Services Directions 2017 and requests for compensation from employees in accordance with section 73 of the Public Service Act 1999. The Branch also processes requests for access to information under the Freedom of Information Act 1982 and requests for external review of FOI decisions.

Essential requirements

Applicants must be admitted to practice as a legal practitioner of the High Court or Supreme Court of an Australian State or Territory, and have or be eligible for a restricted ACT p
